Well, since this also happens naturally and all the time it will be hard to differentiate.

And do you get executed for insect extinctions? And how do you prove that you just did that?

But I agree that wilfully exterminating a species should be punishable. Maybe not by death.

And the blame shouldn't fall on the last poacher who shot the last individ. The blame should be put on those who are responsible for the majority of deaths of the species. Governments, corporations, powerful individuals etc. And these are generally hard to tackle legally.
