Supreme Court ruling on death penalty for rape

I don't recall if this has been brought up yet but I just read/heard about it and heard the Supreme Court is ready to weigh in on this.

From an emotional standpoint and having a daughter of my own, I think the death penalty in case of rape would be the right thing to do.

Rationally, it only gives rapist an incentive to kill their victims after the rape to remove any potential eye witness testimonies.

I agree with the death penalty for rapists, even if both are underage and drinking has been involved and the guy is black and the girl doesn't want anyone to think she had sex with him so she cries rape... actually, hmm...

I think some rapes justify the Death penalty. I think aggravated assault, kidnapping, torture, underage victims, could all add up to a death penalty case, especially if their are multiple victims. But, in a statutory rape case, that would would be jacked up to give someone the Death Penalty. The way our justice system seems to work you know it would happen. It's too bad we can't have a little common sense in the justice system. People kill people and get 6 months and some poor fool gets caught with a lb. of weed and does 5 years.

Even the outdated and primal eye-for-eye ideology doesn't have this equate.
Practically, it already costs so much to try a death penalty case (more than the cost of lifetime incarceration) that it is asinine to suggest throwing more problems on the criminal justice system.

The state has no right to determine who lives and who dies, especially in aggravated sexual cases.

Interesting: I actually wrote a paper on this in law school. I advocated the death penalty for crimes of forcible rape, and I advocated the overturning of Coker v. Georgia.
But I never thought it would actually happen.
P.S. I got an A on the paper, despite my teacher's professed aversion to the death penalty.
