The AP article is different than the one written by the journalist who lives in Louisville:

Quote:
Curt Drake, one of the family's attorneys, said the jury arrived at the total by awarding $792,000 to Brandon Patch for his lost earnings and pain and suffering, an amount that goes to his estate. The family was awarded $58,000 for their pain and suffering and damages.

Ahh hmm. Kind of weird to award lost wages damages in that way.

It sets a precedent for all sports equipment though. Anything that could remotely cause the injury

all they have to do is print a warning on their equipment and they avoid all lawsuits. very simple.

"the dangers of using aluminum bats"... really?
How much faster could it have been going?

How many deaths do you get in baseball from being struck by a ball?
I know we get a few in cricket, but cricket balls are harder and heavier.

Unnecessary to even need the warning though.

Actually they do, when they hit the ball it bends the thin walled bats in then pops back into place.

Softball bats are real bad/good at that. Mens slow pitch leagues bust guys with illegal bats all the time.

I mean the whole premises of needing the warnings in the first place for something a reasonable person knows could happen. And you say you're a businessman which means you think differently, I worked for a small business for 3 years and did my undergrad in business and sport management. I know all about wanting to avoid law suits.
