Dude, I hear you man. Lawsuits, Court, Lawyers, SUCK. Its almost like your life is in limbo, you cant really plan to make any advancements in your life because it holds you down mentally, phsically, and FINANCIALLY until the shit is done. I got into a fight at a bar with some asshole who made a rude comment to my girlfriend. The asshole got knocked out and hit his head on the curb... I got arrested and now he is suiing.
The stress of all this shit has really caused my life to go down the tubes. 5k in initial lawyer costs and broke up with my girlfriend, cant purchase the condo I was going to because if I lose he could take it away from me... it sux man. We live in a great country, but DONT GET IN TROUBLE, it will change your life big time for the worse.

Well, we just learned today that the insurance only told him that they would pay 100,000 dollars. They only payed to replace his car. If this guy hadnt been working this whole time Im sure we would have had a lawsuit earlier.
There is a logical reason behind it i guess, but I didnt really understand when it was explained. Something about settling it all with one big payment instead of drawing it out...I dont know it seems like now it has been drawn out. Either way, the lawsuit still stands. 10,200,000.

First, neither side will want to settle anything in this price range until the long-term prognosis for this guy's injuries are established. If the guy is suing then that means his physicians have determined the extent and limitations of his injuries and how they will impact his future earning potential and quality of life. The fact that the insurance company was willing to settle for 100k already with no litigation leads me to believe he was A. seriously messed up in the accident and B. incurred some serious medical bills in the process. Insurance companies like to lump everything together so the sum appears larger than it actually ends up being once it is broken down. Alot of times victims see the $$$$ and don't pay attention to the fact that most of that is going to cover medical costs. 100k isn't a whole lot if you have 20k in medical bills plus attorney's. An insurance companies first offer is almost always going to be a low-ball figure.
There are a couple of things going in your GF's favor (if you can look at it that way). The insurance co. hasn't settled yet, that means for the mean time she is still somewhat protected and her ins. co. will handle and incur most of the litigation and expenses. I just hope she has decent liability and PI protection. Also, lawsuits like this aren't all or nothing. Even though your gf might be considered at fault, it's highly unlikely in this circumstance she would be considered 100% liable. That significantly reduces the 10mil plus the guy is asking. Rarely is someone awarded what they actually sue for, unless this guy is a pro athlete and he's become paralyzed from the accident he's not going to get close to 10mil. Bottom line, at this stage of a lawsuit things are much more bark than bite. This guy's attorneys are really doing nothing more than seeing if they can intimidate your gf's insurance company into raising the settlement offer. Sadly, the cost of litigation often times makes outrageous settlements a viable option.

Very informative thankyou. I am gonna have to look at this 100k figure. Im curious as to what the hell is really going on.
I figured the high dollar value he wants was just an effort to scare them all into a settlement? Why is he going after them if you say they want the insurance to pay more? Shouldnt his auto insurance be doing that?

So today im helping her get her police reports and insurance papers together, and her dad is hiring some big shot lawyer guy who is supposed to be pretty good. We also talked to a PI to sniff out any dirty shit this asshole is trying to pull...you know fraudulent claims, etc.
So she leaves my house and is on her way to the CHP station to get more paperwork, and this cock sucking cop pulls her over and gave her a ticket for failing to signal or something. I am also a cop, and she told him. He said he already started writing it and couldnt stop. This guy even works on the same department as me. He fed her some line of shit and said have a nice day. She just called me in tears and now i feel like shit.
Only serious responses, I have had enough jackasses for a day.

So you are a CHP? Is it policy that CHP give tickets 100% of the time or what?
I just got a ticket recently from a CHP. It was about 1am and there were many drivers out. There was noone near me. I was driving about 80 or so. I decide to take the next exit to get a bite to eat. As I get off I see a car approaching me from behind. Eventually the CHP pulls me over and says I was going APPROXIMATELY 85mph. I don't know if he had radar or what. I'm still pissed about that.
I've only heard of one time a CHP let someone off. My wife is a SD Sheriff and was on her way to work in uniform. She saw the CHP on the highway and decided not to pass him even though he was going 60mph in a 65. Eventually she decided to speed up to the limit of 65 therefore passing the CHP. He pulled her over.
He sees that she is a cop to and says he doesn't believe in giving other cops tickets. But then got all unprofessional talking about how SD Sheriff's gave his wife a ticket and he didn't appreciate that. Personally I'm glad his wife got a ticket because the CHP puts the shaft to everyone. They don't deserve to get a break either.
I feel so sorry for your girlfriend. I hope that situation improves.
