My GF is having the worst day ever

So she gets in this car accident 2 years ago that was her fault. The statute of limitations on this guy suing her for anything was on march 26. Her insurance company settled with this guy and over 2 years payed him 100,000 dollars. He had an injured knee.


This morning, he served her mom papers saying that he was suing her. They were filed on March 16, and this guy is also suing her dad. On the list are punitive damages, Malice, oppression, and fraud. Her car accident involved her crashing first by herself and getting knocked out unconcious, then this guy hit her car a few mins later. The kicker was she was over the limit with alcohol. No criminal charges were filed or anything like that. Just suspended license and some other small stuff.

So anyway, this guys papers say all the above and also say that he cant work, has mental anguish and medical bills still. He is suing for current and future medical expenses for 200,000 additional dollars on top of the 100,000 already payed. This is all for his knee mind you. His mental anguish is, get this 10 million dollars. This guy wants to sue for 10,200,000 for hitting a crashed car and injuring his knee.

So today im helping her get her police reports and insurance papers together, and her dad is hiring some big shot lawyer guy who is supposed to be pretty good. We also talked to a PI to sniff out any dirty shit this asshole is trying to pull...you know fraudulent claims, etc.


So she leaves my house and is on her way to the CHP station to get more paperwork, and this cock sucking cop pulls her over and gave her a ticket for failing to signal or something. I am also a cop, and she told him. He said he already started writing it and couldnt stop. This guy even works on the same department as me. He fed her some line of shit and said have a nice day. She just called me in tears and now i feel like shit.

Only serious responses, I have had enough jackasses for a day.

How much do you charge?

The oppression, im not sure. Fraud and Malice are shit excuses for a bloodsucking lawyer to make him sound like he has a suffering client and my gf is evil. Thats my take anyway. Malice means like it was premeditated and she wanted to do it, so hes trying to use the DUI for that im sure. Maybe a lawyer on here can give us the insight on the other two.

Well, if he was a manual labor worker with no other skills and he can no longer support himself any other way, then it's a valid lawsuit--though it seems he is suing the wrong people and 10 million is surely excessive.

$100,000 isn't enough though if he is permanently unable to go back to his previous job.

Well she's got the lawyer already and that's the best thing she can do right now. Other than that, and I mean this seriously, she maybe needs to take a look at herself and her lack of responsibility as a driver.

Any way, if this guy crashed into her, wasn't her car freakin' stationary? So how much attention was this guy paying?

He was probably going to visit his sick grand mother, when it happened,

Nah the guy is like 60 years old. Maybe he is retired I dont know. Ya the car was stationary, it crashed in a well lit area and he wast 100 yards behind her according to a witness. I also just found out that she crashed due to a tire blowout and was traveling 67 mph, so DUI or no DUI it could happen to anyone.


As far as taking a look inside herself like someone else said, im sure that will be noted in court. Instead of not working and collecting unemployment cause she couldnt drive, she moved 5 hours away and started working where she could walk to work. There is no more drinking and driving of course and she hadnt had any tickets or anything until today, and has gone to school this whole time. I mean shit, she made a mistake. Im sure most could admit at drinking and driving atleast once in their life.

Dont get me wrong, still it was her fault, and I feel bad that an innocent guy got hurt for no reason. It just seems pretty iffy and that this guy wants to milk it for everything he can.
