Icon11 Hands free driving... er ... riding?

California just enacted a law that makes it illegal to drive and talk on a cell phone unless you are using a hands-free device (i.e. bluetooth). California laws also state that a bicycle must follow all the applicable laws that cars must follow.

So is it illegal in CA to talk on a cellphone while riding a bicycle without using a hands-free device?

Nobody talks on their cell while driving anyways.
They're all too busy texting.(which is still legal)

It's not even the hands-on part that makes cellphone driving dangerous. Cognitively the act of having a conversation with someone taxes your attentional resources and so it diverts your focus from the road.

The difference between talking with a passenger and someone on the phone is that the passenger can see what the driver has to pay attention to and so the conversation is altered accordingly.

Bingo.

Couple that with the fact that driving dangerously is already illegal (reckless driving) and you have even more evidence that the State of California is run by absolute morons.
