Can you claim unemployment if....

Your employer never fires you, never says a word to you and never brings up any disciplinary action against you, but suddenly removes all your scheduled hours, indefinitely?

You better be able to. I claimed it before from having reduced hours so you should be okay.

Not happening to me, but to my sister.

She works 2 jobs (part time on both) And when she went to work last week her hours had been completely removed for the upcoming week. Today she went in and talked to the manager and told her that she was going to claim unemployment (which she cand do in CA because she is under 40hrs per week.) The manager laughed at her and said, you cant because you are not fired, your name is still on the schedule.

I know this is wrong, and their is a legal term for it (was thinking Default Termination) but that is not it, just trying to figure it out.

Because even though she never quit and they never fired her they will not issue her her final check until she turns in her work uniform. (in essence acquiescing and saying "ok I quit" so she wont ever be able to file unemployment.)

Why is the boss being such a prick? She should not only claim unemployment, but she needs to report him if he really said that (especially in a laughing at her tone).

I am a union operator in Michigan and I get laid off every winter (so I collect unemployment every winter)

If you were not fired because you screwed up at work or quit, you should be able to. If your employer denies your unemployment, don't start worrying right away. You have a chance to send the unemployment office a written explanation for your loss of employment, where they can overrule your employers decision.

I'm pretty sure the manager is wrong. Your best bet is have your sister call the unemployment office and tell them the situation. Here in Michigan, you can even collect partial unemployment, if your work hours get severely reduced.

Yeah, she is going to.

But I am going with her on Friday to pick up her check and I want to have all the info I can to counter the arguments of these fucking idiots.

No you can't, because as an employer I simply say I never termed you. When I get that little letter from EDD, I'll smply state you were not terminated.

But I have an At Will Contract my employees sign.

So that avoids alot of the B.S. employees try to screw the system over with.
