Oh STFU! Bj Penn is an amazing fighter and talent wise he is probably the best. However he is not the P4P best. The Spider and Fedor are easily more proven commoditys.
The truth. Why? Just because you've fought in a bunch of weight classes doesn't make you the best. You have to actually win fights often and be dominant to be the p4p 1. Beating Sherk will help.
...but also, who the fuck cares? Everyone in the heavies is so concerned with stupid, useless lists and get all riled up when someone doesn't agree. They don't matter, and the p4p list matters even less.
actually, yes. the very definition of p4p is being great regardless of your weight class. and he has proved that by capturing titles at higher weight classes, and beating fighters that outway him by more than 30 lbs.

If you're going by "beating guys that outweigh him by x amount of lbs.", than Fedor is undisputed.
