DOING A CRIME MEANS BIG TIME!
ROBBERY II: You alone or with a friend want someone's baseball cap. You either pretend to have a weapon or threaten to beat the owner up. You and your friend go to prison for 5 years and 10 months.
ASSAULT II: You and a friend get into a fight with another person. Your friend pokes the other person in the eye with the handle of a hairbrush, a stick, etc. (NO WEAPON OR OBJECT IS EVEN NEEDED! SIMPLE INJURY SUCH AS A BROKEN NOSE EQUALS THE SAME THING!!!) The eye is injured. You and your friend go to prison for 5 years and 10 months.
SEXUAL ABUSE I: You and a date are at a movie. You touch your date's buttocks, crotch, or breast. Your date tells you to stop. You ignore this and touch your date there again. You go to prison for 6 years and 3 months.
KIDNAPING II: You hear that someone is messing with your friend. You go to their house and force them outside to beat them up. You go to prison for 5 years and 10 months.
MANSLAUGHTER I: You are driving under the influence of alcohol and/or drugs. You cause an accident and someone dies. You go to prison for 10 years.

NO! This law says the judge MUST send ANYONE, both boys and girls, to prison who is 15 or older and guilty of a Measure 11 Crime. IN FACT! The JUDGE can't JUDGE at all. There might as well not be a judge in the system at this point! The DISTRICT ATTORNEY is the one and only one who makes all the decisions since this measure imposes MANDATORY MINIMUMS!!!!!
WHY DOES MEASURE 11 PICK ON KIDS?
Measure 11 doesn't pick on kids. It picks on everyone. It says that kids and adults can no longer pick on others and get away with it. Kids often hurt other kids. Measure 11 was made not to pick on young people, but to protect them.
What EXACTLY is Ballot Measure 11?
Oregon voters approved Ballot Measure 11 in November 1994 to apply mandatory minimum prison sentences to certain crimes against persons committed on or after April 1, 1995, with no possibility for any reduction in sentence, such as for good behavior.
Assault II carries a MANDATORY MINIMUM of 70 months. (5 years 10 months for those of us that suck at math.)
You ask.. why Assault II?
Well the "victim" in the case sustained an injury and his ear is supposedly still ringing. I can't go into details of exactly what those injuries were, but, I can tell you that this was a street brawl with about 12 people involved. 1 of which was my "best friend" who told the Police he didn't do anything and all he was trying to do was stop the fight. Which is kind of funny considering he kneed one of the other guys in the head.
Even more funny.... I was jumped by 4 guys - one had a baseball bat.... 7... yes... SEVEN days prior to this. My c7 vertebrae was bruised/damaged. My wrist was cracked and I had 3 broken fingers. Not to mention the other rib injuries and numerous bruises. Oh, the concussion too.
COMMENTS FOUND ON HIS FRIENDS PAGES MYSPACE DATED NOVEMBER 11TH - LESS THAN 8 DAYS AFTER HE WAS "RELEASED FROM THE HOSPITAL."
Victim - November 11, 2006 - "I'm working on getting VIP room at a club for friday, my birthday. I'll have final details tomorrow."
Victim - December 8, 2006 - "It was great seeing you last night! I had a lot of fun!!! We partied our asses off!!! We'll have to do it again soon.

Does this sound like someone who is suffering from injuries of that magnitude? 6 years of my life? For him hitting the hood of my car and his blood alcohol level being .198 by the time he got to the hospital over an hour after the incident took place? WTF IS WRONG WITH THIS PICTURE??!
So. I have 2 choices. Take a plea or go to trial. If i go to trial i risk going to jail.... no... PRISON for almost 6 years. NO good time... NO NOTHING. GAME OVER.
Or, I take the usual plea bargain the DA offers and seals up another case. It's really a sweet deal for the oregon justice system.
So-
Official charge will be Attempted Assault II. I will be serving 24 months. I will qualify for good time. I get time served for when I was arrested and in jail for almost 50 days. Plus I am supposed to be getting credit for the time I have been on house arrest.
I have court again on the 16th or 17th of July at which time a date will be set (most likely the following day) where I will enter a change of plea and plead out to a lesser crime, taken into custody and I will be gone for at least 16 to 24 months depending.
