You really should send them a certified snail mail letter (per enright's suggestion) explaining how they broke your contract and requesting your money back (minus four days before they removed the equipment). Make a photo copy of everything. It will make your case much more likely to succeed when you get to small claims court. Email doesn't cut it. Everything should be done in writing.

Small claims court will give you a ruling, but it doesn't guarantee you'll get your money back.

Chaos is correct. You also need to CC the letter to the PF corp and the BBB in your state. This means you need to copy the letter and also send it to both places above. By putting a CC on the bottom, you are letting the manager know who else will get a copy of this letter.


This is what every lawyer does when they send a "threaten to sue letter" for these kind of cases. If you ever go in front of a judge in small claims court, having your paperwork in order will make the judge very, very happy.

No it does not - but here is what happens in these kind of cases. Once you send a "I'm going to sue your ass letter," the manager of the store is required to turn it over to corp. Corp will either settle the case with an in-house counsel or turn it over to a private lawyer. Even a cheap associates lawyer's hourly rate is $100+. It would cost PF more than $1000 to defend this class in small claims court. Actually, the cost would probably run over $2500 if they had to go to court. If they really think you will sue, trust me - they will let you out of your contract and give you your money back.

You just need to get the right people to read your letter.
