Do I think Osama should have access to criminal courts if captured alive? Personally, I think so. I don't subscribe to the idea that some people are just such bad people that they shouldn't be given a fair trial.

Military tribunals exist because it is not practical to hold trials for tens of thousands of captured troops one at a time, particularly when the evidence is against the group and not a particular individual.

But when a single person is captured, it's only civilized to have a trial. Only tyrannies don't try individuals fairly.

But he will probably be tried by Afghanistan or Pakistan or have a bomb dropped on his head so I don't know if this will even be an issue.
my point is, he isnt even american but attacked americans and some want to give him these rights. lincoln of all people saw americans as not needing these rights for a duration of time.

and you dont think there are such bad people out there that they shouldnt be given a fair trial, some people are very bad, and very very very rich, and any trial will probably get them off the hook.
