The U.S. Supreme Court has decreed (incorrectly) that no death penalty may be imposed in the absence of a homicide. (The case is Coker v. Georgia, if you care.) I believe the Louisiana statute has something to do with rape and transmitting HIV/AIDS. I may be wrong.
Oddly enough (or not), I wrote a paper in law school arguing that Coker v. Georgia should be overturned. PM me if you want a copy.
